Auditors Third Party Liability Essay On 1979 the court established the principle of third party liability as foreseen’ in Federal Supreme Court (sixth civil senate) 1 regarding the case of a German branch of a bank provided wrong information to its potential investors and because of that one of the potential investors suffered a big loss and later sued the bank. But in November 1983 in Federal Supreme Court (fourth civil senate)2, death negligence in reporting in a case where buyer of a properly sued the valuer because of the wrong valuation. Court stated that if third party is under protected effect then there are some general principles on professional third-party liability for negligent misstatements under contract towards third parties. In the first case (1979) The Federal Supreme Court stated that the bank knew that the information which was provided would have been showed to potential investors In the case court maintained that the person, to whom the bank provided the relevant information could be identified and are part of a calculable group. And in the second case (1983) court says, there is no need for the professional to know either who the third parties are. The professional’s negligent performance must have determined the plaintiff’s decision which eventually led him to suffer a loss. Court found out that because of the lack of knowledge both buyer and dealer needed the expert opinion of the valuer was needed. Court widened the scope of the liability and liability of auditor to third party moved from Foreseen to reasonable foreseeability. After that case Federal Court continued this broader scope of liability in both cases in Federal Supreme Court (third civil senate) 10 November 19943 Federal Supreme Court (third civil senate) 2 April 19984 On 2001 in its most recent case, the Federal Court of Justice handed down a new decision regarding the liability of experts towards third parties (Reg. No. X ZR 231/99). The Court rejected the plaintiffs claims, holding that the contract concluded between the commissioning banking authority and the expert did not extend to the plaintiff. So, the plaintiff was not, covered by the contract drawn up between the commissioning authority and the auditor. The court reject the information contract between the expert and the third party a stated that without a direct contract no liability is considered to have arisen. The court then changed the scope of liability form reasonably foreseeable to Privity or Near Privity in between.

Comparison of Sound of Waves and Sailor Who Fell From Grace with the Sea There are many similarities between Yukio Mishima's â€Å"The Sound of Waves" and â€Å"The Sailor Who Fell From Grace with the Sea,† but there are also some important differences. The endings of the two novels seem to oppose each other, however some of the imagery and characters personalities in the novels make them very similar. In â€Å"Sailor,† one of the main characters is named Ryuji. He is a sailor, and later a father, and plays a central role in the novel. In â€Å"Waves,† Ryuji is used as the name for a character again. However, this Ryuji is not seen often in the action -- he is instead a medium through which the two main characters are forced to communicate. The Ryuji in â€Å"Waves† is also a young boy, while in â€Å"Sailor† he is a weathered man. In both novels, the Westernization of Japan is used as a motif. In â€Å"Sailor,†Fusako is the proprietress of an import shop and her home and lifestyle are both very Western. This Westernization is something that would lead to the eventual downfall of Ryuji. In â€Å"Waves,† Churiko, a more western-thinking, college-educated girl, is the character that creates the problems which must be overcome. It seems that Mishima is trying to communicate to the readers that Westernization is not a good thing for Japan. In r eal life, we know that Mishima did think this was true. He would commit ritual suicide for his beliefs about the emperor. The sea is of course of central importance in both novels. Surprisingly though, the two novels do not share the same view of the ever-changing force. In â€Å"Sailor,† Ryuji describes the sea as, â€Å"another kind of prison.(16)† In â€Å"Waves†, Shinji, the main character, feels surprisingly free when he first ventures onto the sea: â€Å" ‘I'm free!’ he shouted in his heart. This was the first time he had realized there could be such a strange sort of freedom as this.(150)† Another contrast between the two books deals with the ending. In â€Å"Sailor,† it is the fulfillment of love that causes the death of Ryuji, the heroic seaman. When Ryuji finds Fusako he stops his work as a man of the sea and chooses to work in her store to make her happy. In â€Å"Waves,† the young lovebirds are not destroyed by the s ea as Ryuji was, they are united by it. Leadership Outline

Peter O’Brian COLL/148 Due: October 7, 2012 Week 5 Leadership Outline: 100 point I. Introduction My project is about Peter O’Brian who completed the same major as myself but also doubled it with film. Something I look to doing in the near future. O’Brian has a BA in Communications and in Film he is a Canadian Producer and is considered â€Å"perhaps one of Canada's best-known film producers† (Kayne, 2003). O’Brian is someone I aspire to be because of his background with my degree and with my passion for film. O’Brian has overcome many obstacles and has built a beautiful foundation for future entrepreneurs to follow.O’Brian is an expert in communications because he had to market himself to get funding for his films, he had to have Public relations abilities to self-promote his films and he had to gain an expertise in what he was doing. II. Your Field of Study I chose to do Communications because I liked the options for a career that cam e with it. With a Bachelor’s degree it gives me credibility for work I already do and can be combined with a degree such as film to make me the well rounded person I aspire to be. My expected graduation timeline is the spring of 2014 or that winter.I hope to graduate within this timeframe because of the projects I have planned for the same year. In order to get in that timeframe I will have to take extra classes and really push myself academically to achieve this. III. Who is the leader I chose Peter O’Brian because he is a personal idol of mine and because his education background helped me when deciding my own. O’Brian has a reputation of being a film maker who demonstrates in his movies relativeness and connections with the people who see his films. He illustrates characters that anyone can look up to and aspire to be.For film he has won 19 genie awards (Canadian Film Encyclopedia) and for communications he has demonstrated public relations skills to be his o wn publicist. IV. Characteristics of an effective leader An effective leader is creative and opened to new ideas (Vulliamy, 2010). I think O’Brian has clearly demonstrated that. He has created his own production company and sits on many boards to better himself and his business (Canadian Film Encyclopedia). V. Define Your Leadership Qualities My leadership qualities are: being passionate/dedicated, assertive, magnanimity and open minded.My strengths are generating great ideas and getting people pumped to take action. From taking a personality test (Personality Test Center) from this course I’ve learned that I fit into the career I have planned for myself. I also realized that I love to start projects but am not always so keen on finishing them; which is a HUGE problem for me. One personal strength I possess, that can help support success in the future, is that I am great at public speaking. I know how to handle myself in the public setting and also love the environment . A weakness it finishing projects, I love to get them started but when it comes to the middle work I drag.I love the ending work when all the middle work is done but it is a matter of being in the mood to do it. I am going to improve on this by at least trying to start or force myself to make head way and not wait to become â€Å"inspired† because that also can lead to procrastination of the project in itself. VI. Conclusion Peter O’Brian is an evolutional film maker and self-publicist. He is someone I aspire to be like and with his success I feel that he can help motivate me to action and become the person I want to be. The End Of The Civil War - 1807 Words

The end of the Civil War should have signified the end of slavery as well; however, this was far from the truth. President Lincoln’s Emancipation Proclamation referred to only slaves within the southern states (Byng). African Americans found themselves no longer bound to their plantation homes, but they also found themselves without the means or rights needed to make new lives. Many of the attitudes and discriminatory practices present prior to the Civil War were still in effect and continued to make the lives of African Americans difficult and in many cases, threatened. The period which followed the end of the Civil War was called the Reconstruction. The South was a disaster, and the North was dealing with the economic and social damage that the South had incurred. The states needed to work to build themselves back to what they had been prior to the destruction caused by the Civil War. Blacks were no longer slaves. They were granted the same legal protections as whites t hrough the passage of the 13th, 14th and 15th Amendments of the U.S. Constitution (Byng). They were given their freedom. They were recognized as citizens of the United States. They were given the right to vote. Many African Americans were able to serve in public offices. These new liberties and responsibilities, however, did not come easily to them, and with the end of the Reconstruction era, they abruptly halted (Byng).
